Marriage License and Eligibility

To marry legally in New Jersey, couples must:

Apply for a marriage license in the municipality where one resides, or where the ceremony will occur if both live out of state
Present valid government ID, proof of residency, and social security numbers
Pay a $28 application fee
Be at least 18 years old, not in any other marriage, civil union, or domestic partnership

There’s a mandatory 72-hour waiting period after applying, and license applications are valid for six months.

Authorized Officiants

Ceremonies can be performed by:

Judges (Superior, Federal, Municipal)
Mayors or municipal officials
Religious ministers and clergy
Different officiant types have varying legal authorities—choose according to your needs.

Equality and Partnership Protections

New Jersey recognizes marriage equality, civil unions (for similar legal benefits), and limited domestic partnerships (for couples where both are 62+ or registered before 2007). All marriages offer full legal protections: inheritance, medical decisions, and tax benefits.

Marital Property and Equitable Distribution

New Jersey uses “equitable distribution” in divorce, meaning marital property is divided fairly, but not always equally:

Assets acquired during marriage are marital property
Separate property (premarital assets, inheritances, validly protected assets) can be kept outside division if not commingled
Courts consider many factors: length of marriage, contribution to family, debts, earning power, and more

A prenuptial agreement offers couples control, clarity, and protection for individual assets and obligations.

Divorce, Dissolution, and Mediation

No-fault and fault-based divorce grounds are recognized, with mediation encouraged before litigation to reduce costs and conflict. Civil unions and domestic partnerships follow similar principles for dissolution and property division.
